Memorial Prayer Cards Terms and Conditions

TERMS AND CONDITIONS

A.) Some photographs can still be under the copyright ownership of the photographer who took them. When we receive a photo or scan from you, we do so on the understanding that if it was a professional photo, you have obtained permission to use it for your memorial or the photo is not subject to copyright.

B.) In scanning your photograph yourself you are assuming responsibility for the quality of the final image. Memorial Prayer Cards would be happy to scan the image for you at no extra cost.

C.) In giving your approval of the proof for printing of the Memorial Card, Funeral Program Cover, Bookmark design or any other Memorial Prayer Card product you are approving the final design, the accuracy, spelling, color and grammar of all text (including names, dates, prayer, etc.) on the design and the images used in the design.

D.) Massachusetts State residents are subject to sales tax of 5% on all orders.

E.) DELIVERY AND DELAYED SHIPMENTS
Memorial Prayer Cards will make every reasonable effort to deliver the Shipment according to your requested delivery date, but the delivery date is not guaranteed and do not form part of the contract.

It is your obligation to enter the correct delivery address details at the time of ordering on the Memorial Prayer Card order form. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense. We will provide you with an estimated date for delivery of all parcels. While we make every effort to deliver by this time but all dates specified are estimates only and we are not responsible for any delays. In spite of all our efforts, there can sometimes be unforeseen delays in delivery.

Without limiting the operation of the Terms and Conditions herein, Memorial Prayer Cards will not accept liability for any costs or losses arising or damage suffered due to late delivery and you agree that late delivery does not constitute a failure of our agreement or entitle you to cancel your order. We will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.

REFUND DUE TO DELAYED/LATE DELIVERY
If delivery of your Memorial Prayer Card order by overnight delivery or two day delivery has been delayed/late for reasons beyond our control we will refund the total cost of the shipping fee only. Request of refund for delayed/late overnight fee must be requested in writing by e-mail with-in seven days and must include the tracking number for the shipment.

Some of the images and prayers/poems contained on the Memorial Prayer Cards are believed to be posted within our rights according to the U.S. Copyright Fair Use Act (title 17, U.S. Code.)
